In compliance with the Federal Law on Protection of Personal Data Held by Private Parties (“LFPDPPP”) and its Regulations, and in accordance with articles 8, 10, 12, 15, 16, 17 and 18 of the LFPDPPP, articles 17, 48, 49, 50 and 51 of the Regulations, we provide you with this comprehensive privacy notice (hereinafter “Privacy Notice”) and in this regard we inform you of the following:

A. Identity and address of the responsible party for the protection of your personal information

Moreno, Davila y Asociados, Consultores S.C. (Sherpa Consulting), hereinafter, “the Responsible Party”, with address to hear and receive notifications at Nicolás San Juan 456 Interior B, Colonia Narvarte Poniente, Alcaldía Benito Juárez, C.P. 03020, Mexico City, expressly informs you:

B. Personal data collected and subject to processing

In order to carry out the purposes described in this Privacy Notice, we will collect personal data that, by way of example but not limited to, may be of the following categories:

  • Identification data;
  • Contact information;
  • Employment data;
  • Academic data;
  • Asset data;
  • Financial data;
  • Hobby, entertainment and fun data;
  • Health data; and
  • Others of a similar nature

Your personal information may be collected when you contact us by phone calls, text messages, emails, our website; by completing forms or surveys; by registering as clients; by consulting business directories and other public access sources that provide contact information of potential customers to whom you may have given your consent to share your personal information.
To verify the accuracy of your personal information we will ask you to provide the Responsible party with official documents that allow full identification of the personal data under which this privacy notice must operate. These include:

  • Voter’s ID;
  • Passport;
  • Resident card (Temporary or Permanent), in case of foreign nationality;
  • Federal Taxpayers Registry (RFC);
  • Unique Population Registry Code (CURP);
  • Official proof of address

C. Processing of sensitive personal data and data of minors

We inform you that in certain cases we may collect personal data considered as sensitive by the applicable legislation, for example, your current or future health status. On the other hand, we confirm that we do not collect personal data from minors. If you are under eighteen years old, please refrain from providing us with your personal data.

D. Purpose of processing the collected personal data

Your personal information will be used for the following main purposes:

    1. Original and necessary purposes:
      1. Analysis or studies about interests, consumption preferences or consumer behavior; studies or analyses for statistical or demographic purposes.
      2. Preservation and maintenance of databases with information or personal data until the holder revokes his or her authorization.
      3. Internal audits, to evaluate, develop and improve the quality of our products and services, generate statistical information regarding the client portfolio.

In addition, your personal information will be used for the following secondary purposes:

  1. Secondary purposes:
    1. Sending newsletters, communications, promotions, advertising materials, satisfaction surveys about products and/or services offered or produced by the Responsible party or third parties;
    2. Sending invitations to services, events, programs or activities carried out by the Responsible Party or third parties.

In the collection and processing of personal data, we comply with all the principles stipulated in the Law and its Regulations: legality, quality, consent, information, purpose, loyalty, proportionality and responsibility.

E. Refusal to process personal data for secondary purposes

If you do not want your personal data to be processed for the mentioned secondary purposes , or any of them, you can refuse your consent from this moment on by sending your request by email to privacidad@consultoresherpa.com.
For your convenience, we suggest printing this Privacy Notice; check the box(es) of the secondary purpose(s) for which you are refusing consent and send us a scanned copy to the above-mentioned email address. Your refusal in this regard will not affect your relationship with us.

I do not consent to my data being used for the following secondary purposes:

  • Sending newsletters, communications, promotions, advertising materials, satisfaction surveys on products and/or services offered or produced by the Responsible Party or by third parties.
  • Sending invitations to services, events, programs or activities carried out by the Responsible Party or third parties.

It is important to inform you that the Law establishes that the consent of the Data Subject for the processing of Personal Data is understood as tacit when, having made the Privacy Notice available to them, they do not express any opposition.

F. Transfer of personal data

We inform you that your personal data may be transferred, without legally requiring your consent, to the following individuals or entities:

  • competent authorities, in order to comply with any applicable law, regulation or legal provision, or with any duly founded and motivated mandate;
  • controlling companies, subsidiaries and/or affiliates of Sherpa Consulting;
  • Sherpa Consulting suppliers who predominantly provide the service, so that the referred service can be satisfactorily provided. Personal Data will only be shared while the service is being performed;
  • providers of database administration and management services; automated processing of Personal Data and its storage; email authentication and validation. These service providers and those referred to in item (iii) are prohibited from using your Personal Data for any purpose other than providing this assistance and are required to observe the Personal Data protection principles described in this Privacy Notice;
  • legal entities with which we are contractually obligated to allow them access to the information collected from the studies we conduct, for the purpose of auditing the quality of our work;
  • Your personal data may also be transferred without your consent, in case the assumptions contemplated in Article 37 of the LFPDPPP are updated.

G. Use of cookies and other tracking technologies

We inform you that in our website https://consultoresherpa.com we use cookies through which it is possible to monitor your behavior as an Internet user, in order to provide you with a better service and user experience when browsing our website, as well as to offer you new products and services based on your preferences.

The data we obtain through these tracking technologies are the following: type of browser and operating system; type of device, time and duration of navigation on our website, sections consulted; frequency of visits, or if it is the first time you do so, and the websites accessed before and after ours.

The data collected will be for the exclusive use of the Responsible Party, therefore, such data will not be subject to national or international transfers. We also inform you that you can disable these technologies at any time. To learn how to do this, please consult the technical information of the browser you are using.

H. Security and control measures used for the protection of collected personal data

The Responsible Party has adopted the legally required levels of security for the protection of Personal Data and strives to implement additional technical measures at its disposal to prevent the loss, misuse, alteration, unauthorized access and theft of Personal Data provided to the Responsible Party.

The administrative, technical and physical security measures implemented by the Responsible Party to protect your personal data, are the same that we require to be met by the service providers we hire. All the information and personal data you provide to us will constitute a database owned by the Responsible. The information is stored for protection purposes, to prevent loss, misuse or alteration.

I. Exercise of ARCO rights

Under the terms allowed by the applicable regulations, you may access, rectify or cancel (delete) your personal data, as well as oppose the processing of such data and revoke the consent you have given us for such purpose, through the procedures we have implemented. These rights are known as ARCO rights.

To exercise any of the aforementioned rights, please send us your request in writing to the following e-mail address: privacidad@consultoresherpa.com.
Such writing shall contain the following information:

  • Name, address, telephone number, e-mail address for the purpose of receiving notifications
  • Copy of your voter’s credential, passport, driver’s license, professional license or any other document that proves your identity.
  • The clear and precise description of the Personal Data with respect to which it seeks to exercise any of the aforementioned rights;
  • The application must be duly signed by the applicant.
  • In the case of requests for rectification of personal data, specify the modifications proposed to be made and provide the documentation supporting such request.

Once the request has been received, the Responsible will have a period of 5 business days to request the additional information necessary to process it. Once the above is fulfilled, within 20 business days a response to your request will be given; however, such term may be extended for an equal period of time, which would be notified by the means indicated for such purpose, stating the reasons for such extension.

Likewise, we inform you that in terms of the Law and its regulations, the owner of the data may initiate the procedure for the Protection of ARCO Rights, before the National Institute of Transparency, Access to Information and Protection of Personal Data (INAI), within 15 days from the date on which the Responsible Party gives a response to your request and this is not satisfactory, or if after the term indicated, no response is given to the request.

J. Means to limit the use or disclosure of your personal data

In addition to the procedure contemplated in the immediately preceding section, you may limit the use or disclosure of your personal data in any of the following ways:

  • For e-mails that we send you for promotional and advertising purposes, you may opt-out by clicking on the unsubscribe link that will accompany each such e-mail.

K. Changes to the Privacy Notice

The Responsible may modify and/or update this Privacy Notice, informing you about it through our website. The procedure is as follows: (i) access our website https://consultoresherpa.com In case of modifications or updates to this Privacy Notice, there will be a notification to let you know; (ii) access the Privacy Notice link where you will find the current version with the date of the most recent update.

The Responsible will understand that if you do not express otherwise, it means that you have read, understood and agreed to the terms set forth above, which constitutes your consent to the changes set forth in such updates regarding the processing of your Personal Data for purposes of the Federal Law on Protection of Personal Data Held by Private Parties and other applicable laws.
